Consent Minutes of Order

It is possible to have an agreement that you have reached drawn as Consent Minutes of Order which reflect arrangements for both property division and children’s matters.

Once the documents are drafted in the proper format, they are signed by both parties and sent to the Family Law Courts for filing. A Registrar of the Court will consider the application and seal the documents with the Court stamp it they are satisfied that the agreement is reasonable and equitable. They then have the effect of a binding Court order.

Consent Minutes are a great idea if you have concerns that the other party will not comply with any informal agreement around children and if you want to avoid having to initiate Court proceedings. They also provide certainty and closure in knowing that the property matter is finalised and only in very rare circumstances can only party later apply to the Court to vary the orders. There can also be financial benefit in having your property agreement formalised around issues such as stamp duty if a property is being transferred.

If you have reached an agreement then The Online Family Lawyer can draw the necessary paperwork for you to have the agreement registered in Court as a Court order.  

The filing and subsequent sealing of Consent Orders has the effect of a binding Court order and we therefore recommend that you get some legal advice before signing Consent Minutes of Order. You should not be entering into Consent Orders if you are not happy with them or feel pressured to sign them.

Property division pursuant to the Family Law Act is very complex. We will be reluctant to prepare Consent Minutes of Order for property division unless you have received proper legal advice. If you have not received legal advice but instruct us to prepare the documents then we will have you sign an acknowledgement to that effect outlining the risks.


The Online Family Lawyer’s fees for the preparation of Consent Minutes of Order are as follows:
  • $1.850.00 + GST
  • A percentage of your fees will be donated to one of our partner charities.
The fee includes:
  • Liaising with you to take instructions
  • Preparation of Application for Consent Orders
  • Preparation of Consent Minutes of Order in the correct format
  • A detailed letter to you providing further information relating to the following:
    • Consent Minutes of Order and filing of the same;
    • the considerations that the Court must take into account when making orders about children; and
    • factors taken into account by the Family Law Court in property matters
  • A draft letter to you to send to any Superannuation trustee if superannuation splitting is required
  • A letter to your ex partner enclosing documents for execution




The fee does not include expenses such as the Family Law Court filing fee which is currently $80.00. The fees also do not include giving effects to the Order (for example preparing transfer documents for the matrimonial home).

We do not accept any responsibility if the other party refuses to execute the necessary documentation or if the Family Law Court refuses to seal Consent Minutes of Order if they are not considered to be reasonable or equitable.
