Parenting

We are specialist Family Lawyers.

We guide you through your parenting matter whether your separation has been amicable … or not so amicable.  There is no ‘one sized fits all’ solution for your matter as every family situation is different.

We will always use Court as a last resort and do our best to minimise your legal fees.

Oftentimes, clients will consult with us via a Strategy Session prior to attending Family Dispute Resolution or mediation through services such as Relationships Australia. In the session we can ensure that you have all the information available to you, know what to expect and most importantly know what the law would recognise as being a reasonable agreement.

If you have reached an agreement with your ex partner then we can assist you to draft Parenting Plans and Consent Orders to ensure your agreement is legally binding.

If more negotiation with your ex partner is needed then we can discuss options with you such as instructing us to negotiate with your ex partner (or their lawyer) or attending lawyer assisted mediation with you. We attend hundreds of mediations each year with our clients. If you prefer to attend mediation without a lawyer then we can ensure that you are fully informed and armed with knowledge before you attend.

If you have been issued with a s60I certificate and need to go to Court then rest assured we conduct a large amount of Court work. Our solicitors will give you the option of attending Court hearings without a barrister so as to minimise your legal fees.  We are also experts in urgent Court proceedings where Recovery orders or Airport Watch List orders are needed.

If there is an Intervention Order (family violence order) in place listing you as either a defendant or a protected person then mediation may not be suitable for you. If your children are in your care and listed as protected persons from your ex partner then you may not need to do anything further at this time. If you are named as a defendant then you should get family law advice to explore ways that you are able to spend time with your children.

You may have Court orders in place already but are concerned that your ex partner is breaching those orders.  We can assist you with any Enforcement or Contravention Applications. Generally speaking, Contravention Applications are quasi criminal and the person breaching the orders needs to have a ‘reasonable excuse’ for not comply with orders.
