Parenting Plans

If you have reached an agreement with the other party around arrangements for the children, a Parenting Plan is an economical option for you to ensure that your agreement is properly recorded without the need to initiate Court proceedings.

We suggest that you get some legal advice before signing a Parenting Plan. If you have not received legal advice or have questions around the Parenting Plan then why not get in contact with The Family Law Project’s office or obtain some information from The Online Family Lawyer.

A Parenting Plan is a document which outlines the arrangements of children’s living arrangements. It stipulates things such as where the children live and how much time they spend with each parent or other significant people in their lives. It should include information about who has parental responsibility for the children. Parental responsibility is quite commonly shared but in some circumstances one person may have sole parental responsibility. The Parenting Plan should consider things such as telephone communication, handover locations and contact with parents on special occasions.

Often parents will reach an agreement at a Family Dispute Resolution (FDR) and want that drawn more formally into a Parenting Plan. In order for parenting agreements to be formally recognised by the Family Law Courts they should be drawn properly and singed and dated by all parties. Although themselves not legally binding, if prepared correctly a Parenting Plan can later be shown to the Court if your matter ends up in the Family Law Courts.
