Consent Minutes of Order

Property division pursuant to the Family Law Act is very complex. We are happy to provide you with advice prior to agreeing to any property division with your ex partner. We will be reluctant to prepare Consent Minutes of Order for property division unless you have received proper legal advice. If you have not received legal advice but instruct us to prepare the documents then we will have you sign an acknowledgement to that effect outlining the risks.

The filing and subsequent sealing of Consent Orders has the effect of a binding Court Order and it is therefore extremely important to get advice prior to signing any document.  

If an agreement has been reached between you and your ex partner then we can have the document drawn in the proper format to be registered with the Family Law Courts. A Registrar will consider the documents and, if satisfied that the agreement is fair and equitable, they will seal the document with the Court stamp. The document then becomes a binding Court order.

You should not be entering into Consent Orders if you are not happy with them or if you feel pressured to do so.

Consent Minutes of Order in relation to property can deal with things such as the transfer of real property, payment of any lump sum monies, splitting of superannuation and transfer of any other property. There can also be financial benefit in having your property agreement formalised around issues such as stamp duty if a property is being transferred.


The Online Family Lawyer’s fees for the preparation of Consent Minutes of Order are as follows:
  • $1.500.00 + GST
  • A percentage of your fees will be donated to one of our partner charities.
The fee includes:
  • Liaising with you to take instructions
  • Preparation of Application for Consent Orders
  • Preparation of Consent Minutes of Order in the correct format
  • A detailed letter to you providing further information in relation to Consent Minutes of Order, considerations of the Family Law Court in property matters and information about filing of the same
  • A draft letter to you to send to any Superannuation trustee if superannuation splitting is required
  • A letter to your ex partner enclosing documents for execution
The fee does not include expenses such as the Family Law Court filing fee which is currently $80.00. The fees also do not include giving effects to the Order (for example preparing transfer documents for the matrimonial home).

We do not accept any responsibility if the other party refuses to execute the necessary documentation or if the Family Law Court refuses to seal Consent Minutes of Order if they are not considered to be reasonable or equitable.
